Who will look after your kids if you die? I know – as a parent just thinking about it is enough to tie your stomach in knots.
Choosing a testamentary guardian for your children is one of the most significant decisions you will ever make as a parent.
If something happens to you, the person you nominate would step into your place. That responsibility is profound.
Parents usually have “someone in mind” – perhaps a sibling or a close friend. But unless that choice is recorded in your Will, you are leaving the decision up to chance – a loved one would need to apply to the Court to be appointed guardian (and the person who makes that application may not be the person you had in mind).
In deciding who to appoint as your children’s guardian, you can think about practical realities as well as emotional bonds.
- Where would your children live?
- Would they stay in the same school?
- Do your values align?
- Have you spoken with the person you have in mind to ensure they are willing and able to take on the role?
Putting this decision in writing is an act of love. It spares your children from uncertainty and gives your chosen guardian clarity. It can also reduce the risk of conflict between family members at a time when everyone is already grieving.
You do not need to wait until you have settled on the ‘perfect’ guardian. There is never going to be a perfect replacement for you. What matters is making the best decision you can with the information you have now, so that your current thinking is recorded. You can always revisit and update the decision later if things change, and in the meantime you have peace of mind that your appointment is documented.
