What is included in an Estate Plan?
Your Estate Plan will comprise of a number of different documents, depending on your circumstances.
Will
Your Will sets out how your assets are distributed when you die and who your executors will be. It can also name guardians for your young children.
Enduring Power of Attorney
Your Enduring Power of Attorney allows you to appoint someone you trust to make financial and legal decisions on your behalf if you lose capacity.
Advance Care Directive
Your Advance Care Directive allows you to record your preferences for future health care, personal care and end-of-life decisions, and to appoint someone you trust to make these decisions for you if you lose capacity.
Superannuation Death Benefit Nomination
Because it is held in a trust, superannuation does not automatically form part of your estate when you die. A death benefit nomination is a formal instruction you give to your super fund, specifying who should receive your superannuation benefits when you die and whether the trustee must follow that instruction (binding) or just consider it (non-binding).
Letter of Wishes
A Letter of Wishes is a personal, non-binding letter from you to your executors and loved ones providing guidance about how you would like your estate to be handled, including personal requests.
Family Trust Succession
Like superannuation, property held in family trusts does not automatically form part of your estate when you die. If you have a family trust, we will speak to you about who you wish to control and benefit from the trust in the future. We will then make sure that those arrangements are properly documented so that control of the trust passes as smoothly as possible and in accordance with your wishes.
